Onsite trade services are normally supplied by the contractor identified in your booking confirmation, not by MySubbies. Nothing in these Terms excludes rights that cannot lawfully be excluded, including your rights under the Australian Consumer Law.

Platform Terms & Conditions

Effective date: 1 January 2026 · Version 1.0

1. Acceptance and eligibility

These Platform Terms & Conditions (Terms) form an agreement between Mysubbies Holdings Pty Ltd (ABN 69 693 675 268) (MySubbies, we, us or our) and each person who accesses or uses the Platform (you or User). By creating an account, requesting or accepting a booking, clicking acceptance or otherwise using the Platform, you agree to these Terms and the Privacy Policy.

You must be at least 18 years old and legally capable of entering a binding agreement. If acting for a company, trust, owner, tenant, owners corporation or another person, you warrant that you have authority to bind them. You must provide accurate, current and complete information and keep it updated.

2. The Platform and contracting model

2.1 MySubbies provides technology and administrative services that may include job scoping, indicative pricing, contractor matching, booking, communications, payment facilitation, reviews and support (Platform Services).

2.2 Unless the booking confirmation or a separate written contract expressly identifies MySubbies as the supplier of onsite services, the independent contractor shown in the booking confirmation (Contractor) supplies the labour, materials and onsite trade or property services (Trade Services). The customer and Contractor form a separate contract for those Trade Services when the booking is accepted.

2.3 Contractors are independent businesses and are not employees, agents, partners, franchisees or representatives of MySubbies. They are responsible for how they perform Trade Services, their personnel, tools, vehicles, taxes, superannuation, licences, registrations, permits, insurance and legal compliance.

2.4 MySubbies does not control all onsite conduct and cannot guarantee that a Contractor will accept a request, attend at a particular time, be suitable for every purpose, or complete work without delay or defect. Any checks displayed by the Platform reflect information available at the time and are not a guarantee of future conduct, workmanship, solvency or suitability.

2.5 If a booking confirmation expressly identifies MySubbies as the supplier, clauses that treat the Contractor as the sole supplier do not apply to that booking to the extent inconsistent with the confirmation or mandatory law.

3. Accounts and security

You must maintain one genuine account unless we approve otherwise, keep credentials secure, and promptly notify us of suspected misuse. You are responsible for activity under your account except to the extent caused by our breach, negligence or unlawful conduct. We may require identity, payment, licence, insurance or authority verification before enabling features or releasing funds.

4. Requests, estimates and booking formation

4.1 A request is an invitation to receive an estimate or booking offer, not a guaranteed booking. A booking forms only when accepted through the Platform and confirmed to both parties.

4.2 Prices generated from photos, descriptions, measurements, rate cards or automated tools are indicative unless expressly described as fixed. They rely on complete and accurate information and may exclude concealed conditions, inaccurate measurements, hazardous materials, difficult access, engineering, permits, authority fees, utility works, specialist testing, remediation and work not stated in the scope.

4.3 Before acceptance, the Platform will display or provide the available scope, supplier, price or pricing basis, inclusions, stated exclusions, payment milestones and cancellation terms. Users must review these carefully and promptly correct errors.

4.4 A Contractor may decline a request or propose a revised scope or price after reviewing further information or inspecting the site. No additional work or charge is authorised unless the customer accepts a variation through the Platform or in another durable written form, except urgent work reasonably necessary to address an immediate safety risk where prior approval cannot reasonably be obtained.

4.5 Displayed availability and arrival times are estimates. Weather, traffic, site access, material availability, emergencies, approvals and other events may cause delay. The Contractor must communicate material delays, and remedies remain subject to applicable law.

5. Customer responsibilities

A customer must:

6. Contractor responsibilities

A Contractor using the Platform must:

These Terms do not replace any separate Contractor Agreement, which may impose additional operational, fee, service, insurance and privacy obligations.

7. Permits, regulated work and domestic building work

The booking must state who is responsible for identifying and obtaining permits, consents, inspections, engineering, certificates and statutory insurance. Unless clearly included in writing, these items are excluded from an estimate. No User may request or perform work contrary to law or seek to avoid a required permit, prescribed contract, licence, registration, inspection or insurance.

If work falls within domestic building, plumbing, electrical, gas, pool, demolition or other regulated laws, the relevant supplier must use any contract form, notices, cooling-off rights, progress-payment rules, insurance, registration and documentation required by law. If these Terms conflict with a mandatory requirement, the mandatory requirement prevails.

8. Prices, fees and payments

8.1 Prices are in Australian dollars and include GST where required unless clearly stated otherwise. The checkout or booking summary will identify customer charges then known, including Platform fees, call-out fees or card surcharges where applicable. We will not add an avoidable mandatory charge after displaying a total price without obtaining agreement or as permitted by law.

8.2 You authorise MySubbies and its payment provider to charge, hold, release, refund or transfer amounts in accordance with the booking, accepted milestones, variations, cancellation terms, dispute process and law. MySubbies may collect amounts as limited payment collection agent for the Contractor, but this does not by itself make MySubbies the supplier of Trade Services.

8.3 Deposits and progress payments apply only as shown in the booking and must comply with applicable law. A customer must not unreasonably withhold an undisputed amount. We may delay release of a disputed amount while information is reviewed, but we do not provide escrow, banking or financial advice unless expressly stated and legally authorised.

8.4 Failed payments may be retried. Reasonable third-party dishonour or recovery costs may be charged only where disclosed and legally recoverable. Contractors are responsible for their taxes, deductions and payout details.

8.5 Unless permitted by the Platform or required by law, Users must not pay or solicit payment outside the Platform for a job introduced through it. This protects booking records, payment support and dispute handling.

9. Cancellations, refunds and rescheduling

The cancellation rules and any fee will be displayed before booking or in the booking confirmation. A cancellation fee must reasonably reflect work performed, committed materials, non-refundable third-party charges, travel or loss caused by late cancellation and will not apply where prohibited by law. A customer may be entitled to a refund or other remedy where required by the Australian Consumer Law or another applicable law.

A Contractor may reschedule or cancel for safety, illness, weather, access, licensing, non-payment or circumstances outside reasonable control. Where practicable, the Contractor or MySubbies will give notice and may offer a replacement Contractor or new time. Any remedy will depend on the supplier, cause, work performed and mandatory law.

10. Variations, completion and defects

Variations must describe the change, price or pricing method, time impact and any changed assumptions. Acceptance should be recorded through the Platform or another durable written record. A signature, click acceptance or clear written instruction may constitute approval.

Completion occurs when the accepted scope is substantially completed, subject to minor defects that do not prevent reasonable use. This clause does not remove any mandatory right. The customer should give the Contractor a reasonable opportunity to inspect and remedy an alleged defect where appropriate. Emergency, safety or statutory rights are unaffected.

11. Consumer guarantees and warranties

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other law (Non-excludable Rights).

Subject to Non-excludable Rights, the Platform, matching, availability information, automated estimates and third-party content are provided on an "as available" basis. MySubbies does not make an additional guarantee about a Contractor's workmanship, materials or Trade Services unless expressly stated in writing. Any voluntary workmanship warranty is provided by the supplier named in that warranty and is additional to, not a replacement for, Non-excludable Rights.

Where the law permits liability for failure to comply with a guarantee to be limited, our liability for Platform Services supplied other than for personal, domestic or household use is limited, at our option, to supplying the Platform Services again or paying the reasonable cost of having them supplied again.

12. Safety, incidents and insurance

In an emergency, call 000 and take reasonable steps to protect people and property. Users must report a material onsite incident to MySubbies as soon as practicable. MySubbies may assist communications or request evidence but does not admit liability by doing so. Contractors must maintain legally required and booking-required insurance. Insurance badges or certificates are based on information supplied or checked at a point in time and do not guarantee that an insurer will accept a claim.

13. Reviews and user content

You retain ownership of content you submit. You grant MySubbies a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt and display it to operate, secure, improve and promote the Platform, subject to the Privacy Policy. For identifiable job-site images used in public marketing, we will obtain any additional consent required by law.

Content and reviews must be genuine, relevant and lawful and must not be misleading, defamatory, discriminatory, threatening, infringing, privacy-invasive or manipulated. We may moderate, restrict or remove content where reasonably necessary to enforce these Terms or law. We do not promise to remove a negative review merely because it is disputed.

14. Acceptable use

You must not use the Platform to: commit fraud or unlawful conduct; infringe rights; upload malware; scrape, copy, reverse engineer or overload the Platform; bypass security; create false accounts; misuse personal information; harass others; manipulate prices, bookings or reviews; request cash or off-platform dealings to avoid charges; or arrange regulated work without required authority. Reasonable security testing requires our prior written permission.

15. Suspension and termination

You may stop using the Platform and request account closure, subject to open bookings, payments, disputes and lawful retention. We may warn, restrict, suspend or terminate access where reasonably necessary because of suspected fraud, safety risk, serious or repeated breach, licence or insurance failure, non-payment, legal requirement, or risk to users or the Platform. Where practicable and appropriate, we will give notice and a reasonable opportunity to respond. Clauses intended by their nature to continue will survive termination.

16. Third-party services and outages

The Platform may rely on payment, mapping, identity, messaging, hosting and other third-party services. To the extent permitted by law, we are not responsible for a third party's independent acts, content, terms, outage or security failure, but this does not exclude liability for our own breach, negligence or failure to comply with Non-excludable Rights. We may maintain, change or discontinue features and will give reasonable notice of a material change where practicable.

17. Liability allocation

17.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under Non-excludable Rights.

17.2 Subject to clause 17.1, MySubbies is responsible for loss to the extent directly caused by its breach of these Terms, negligence or unlawful conduct. MySubbies is not responsible for loss to the extent caused by a User, a Contractor acting as independent supplier, inaccurate or withheld information, unauthorised instructions, unsafe site conditions, normal wear and tear, or an event outside MySubbies' reasonable control.

17.3 Subject to clause 17.1 and to the extent permitted by law, MySubbies is not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, anticipated savings or data, or business interruption, except to the extent such loss was reasonably foreseeable and arose from MySubbies' breach of Non-excludable Rights or other liability that cannot be excluded.

17.4 Subject to clause 17.1 and to the extent permitted by law, MySubbies' aggregate liability arising from Platform Services in connection with a booking is limited to the greater of: (a) the Platform fees paid to MySubbies for that booking; and (b) AUD $500. This cap does not apply to fraud, wilful misconduct, death or personal injury caused by our negligence, breach of confidentiality or privacy obligations, or any liability that cannot lawfully be limited.

17.5 Each party must take reasonable steps to mitigate loss. Liability will be reduced to the extent the other party's act or omission contributed to the loss.

18. Indemnity

To the extent permitted by law, you indemnify MySubbies against third-party claims, losses and reasonable costs to the extent caused by your unlawful conduct, fraud, wilful misconduct, negligent act or omission, material breach of these Terms, infringement of another person's rights, or (for Contractors) performance of Trade Services. This indemnity is reduced to the extent MySubbies caused or contributed to the loss and does not require a consumer to indemnify MySubbies for MySubbies' own breach, negligence or unlawful conduct.

19. Complaints and disputes

A User should first raise a booking concern through the Platform promptly and provide relevant records, photos and the requested outcome. The customer and Contractor remain primarily responsible for resolving a Trade Services dispute. MySubbies may facilitate communications, pause a payout where authorised, request evidence or suggest a practical outcome, but is not a court, tribunal, insurer or building expert and is not required to determine legal liability.

Before commencing court proceedings, each party should attempt good-faith negotiation for at least 10 business days after written notice, unless urgent interlocutory relief, a statutory deadline, a safety issue, debt recovery or a consumer's right to approach a regulator or tribunal makes that inappropriate. Nothing prevents contact with Consumer Affairs Victoria, the Victorian Building Authority, Building and Plumbing Commission, ACCC, OAIC or another relevant body.

20. Intellectual property

MySubbies and its licensors own the Platform, software, branding, rate-card structure and Platform content, excluding User content. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose during these Terms. You must not use the MySubbies name, logo or content commercially without written permission.

21. Changes to these Terms

We may update these Terms for legal, security, operational or service changes. We will publish the updated Terms and give reasonable advance notice of a material adverse change where practicable. Changes will not retrospectively alter an accepted booking unless required by law or agreed by the affected parties. Continuing to use the Platform after the effective date constitutes acceptance of the updated Terms; if you do not agree, you may stop using it, subject to existing obligations.

22. General

Notices may be sent through the Platform, to the email or telephone number on the account, or to our contact details below. You must not assign your rights or obligations without our consent, not to be unreasonably withheld; we may assign these Terms as part of a genuine corporate restructure or sale if this does not materially reduce your rights. A delay in enforcement is not a waiver. If a provision is invalid or unenforceable, it is read down to the minimum extent necessary and otherwise severed. These Terms and incorporated booking documents form the agreement about Platform Services, subject to mandatory law.

These Terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals of Victoria and courts entitled to hear appeals from them, but a consumer may have rights to bring a claim in another jurisdiction.
